Chapter I General rules
Article 1 These provisions are formulated in accordance with the Regulations on the Administration of Printing Industry in order to standardize the printing business operations of printing industry operators, improve the management system for undertaking printed matter, and promote the healthy development of printing industry.
Article 2 The printing operators engaged in printing business activities shall establish and improve the printing verification system, the printing registration system, the storage system of printed matter, the delivery system of printed matter, the destruction system of defective products in printing activities and other management systems.
Article 3 Operators of printing industry shall designate special persons to be responsible for the implementation of various management systems such as verification of printing, registration of printing, storage of printed matter, delivery of printed matter, destruction of defective products of printing activities, strictly check and file for inspection.
Article 4 The legal representative or the main person in charge of the printing business operator shall be responsible for the organization and implementation of various management systems of the enterprise and the unit.
Article 5 The administrative departments responsible for the administration of publication under the local people's governments at or above the county level (hereinafter referred to as the administrative departments of publication) and the public security departments shall guide the printing operators in their respective administrative areas to establish various management systems, and shall be responsible for supervising and inspecting the implementation of various management systems for printing operators.
Article 6 Operators of the printing industry shall promptly report to the local public security department and the administrative department of publication when they find any illegal or criminal acts in the printing business activities.
Chapter II stamp verification system
Article 7 When a printing operator accepts the commissioning of printing various printed matter, it shall, in accordance with the Regulations on the Administration of the Printing Industry and other regulations and rules, verify the certification documents of the printing commission unit and the printer, and keep the corresponding copies for reference.
The certifying documents referred to in the preceding paragraph include printing power of attorney or printing certificate, verification, Publication License, Trademark Registration Certificate, registered trademark pattern, registered trademark license contract, advertising qualification certificate, business license and the qualification certificate of the committer.
Article 8 A printing enterprise that accepts the commission to print books and periodicals must verify and keep the original Power of Attorney for Printing Books and periodicals, which is uniformly printed by the publishing administrative department of The State Council and printed by the publishing administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government and affixed with the official seal of the publishing unit.
The Power of Authorization for the printing of books and periodicals shall be affixed with the special seal for the record of the publishing administrative department of the province, autonomous region or municipality directly under the Central Government where the publishing unit is located and the publishing administrative department of the province, autonomous region or municipality directly under the Central Government where the printing enterprise is located.
Article 9 A printing enterprise that accepts the commissioning of printing newspapers must verify the "Newspaper Publication License" uniformly produced by the publishing administrative department of The State Council and issued by the publishing administrative department of the people's government of a province, autonomous region or municipality directly under the Central Government, and keep the photocopy of the "Newspaper Publication License".
Where a printing enterprise accepts the commissioning of printing additional editions or supplements of newspapers or periodicals, it must also verify and keep the documents approved by the administrative department of publication under The State Council for the publication of the additional editions or supplements.
Article 10 Where the procedures of typesetting, platemaking, printing (including reprinting, additional printing) and binding of a commissioned printing publication are different from the same printing enterprise, the publishing unit must issue a Book and periodical printing Mandate to each commissioned printing enterprise.
Article 11 A printing enterprise that accepts the commission to print internal information publications must verify and keep the "Verification of Internal Information Publications" uniformly printed by the publishing administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government and issued by the publishing administrative department of the local people's government at or above the county level.
If a printing enterprise accepts the commissioning of internal information publications with religious content, it must verify and keep the approval documents issued by the administrative department of religious affairs of the people's government of the province, autonomous region or municipality directly under the Central Government and the Verification of Internal Information Publications issued by the administrative department of publishing.
Article 12 A printing enterprise that accepts to print overseas publications on commission must verify and keep the approval documents of the publishing administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government and the legal certification documents concerning copyright; All printed overseas publications must be transported out of the country and may not be distributed or distributed within the country.
Article 13 Where a printing enterprise accepts the entrustment to print the logo of a registered trademark, it must verify the copy of the Trademark Registration Certificate or the Trademark Note Certificate signed by the administrative department for industry and commerce at the county level where the trademark registrant is located, and check the drawing of the registered trademark provided by the client. Where a registered trademark is commissioned by the licensed user to print the logo of the registered trademark, it must also verify the license contract for the use of the registered trademark.
If a printing enterprise accepts the commissioning of printing advertising and publicity materials or printed matter used for product packaging and decoration, it must verify the business license of the commissioning printing unit and the resident identity card of the individual; Those who accept the commission of advertising agents to print advertising materials must also verify the qualification certificate for advertising operations.
Article 14 A printing enterprise that accepts the entrustment to print printed matter of packaging and decoration and other printed matter abroad must verify and deposit the entrustment printing certificate of the entrusting party, and file it with the publishing administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government for the record in advance. Only after the publishing administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government affix the special seal for the record can it undertake the printing. All printed printed materials on packaging and decoration and other printed materials must be transported out of the country and may not be sold within the territory.
Article 15 Where a printing enterprise designated by a public security department accepts the commissioning of printing notices, circulators, work permits for major activities, passes, and tickets for circulation and use in society, it must verify and keep the certificate issued by the competent department of the commissioning unit and the verification issued by the public security department.
Where a printing enterprise is entrusted to print valuable or priceless tickets for internal use by organs, organizations, troops, enterprises and institutions, and to print letters of introduction, work passes, membership cards, access passes, academic certificates, educational certificates or other academic certificates, motor vehicle driving licenses, housing ownership certificates and other special certificates with the name of the unit, It is necessary to verify the commissioned printing certificate of the printing unit and the resident identity card of the individual, and keep the commissioned printing certificate and the copy of the identity card.
Article 16 The operators of the printing industry shall properly retain the various certification documents for verification for 2 years, so as to prepare for inspection by the administrative department of publication and the public security department.
The certifying documents mentioned in the preceding paragraph include the original of the printing power of attorney or the certificate of commissioning printing, the original of the verification, the copy of the Publication license, the copy of the Trademark Registration certificate, the original of the registered trademark design, the copy of the license contract for the use of the registered trademark, the copy of the advertising qualification certificate, the copy of the business license, the copy of the resident ID card, etc.
Chapter III Printing registration system
Article 17 A printing business operator shall, according to the type of printed matter to be printed, register of Publication Printing, Register of Printing of Printed Matter on Packaging and Decoration, Register of Printing of other Printed Matter, Register of Special typesetting, platemaking and Binding business, and Register of Photocopying and printing business (hereinafter collectively referred to as "Printing Register") Name, address, the name, ID number and contact telephone number of the agent, the name, quantity of the printed matter commissioned to be printed, the original copy (or electronic document), the negative and the date of delivery, the consignee, etc.
The Printing Register shall be printed in triplets by the publishing administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government or its authorized publishing administrative department at the local (city) level.
Article 18 The printing operators shall, at the end of each month, report the contents registered in the Printing Register to the local publishing administrative department at or above the county level for the record.
Chapter IV Custody system of printed matter
Article 19 The printing business operator shall keep the original copy (or electronic document), proofs, printing plates, negatives, semi-finished products, finished products and samples of printed materials properly and shall not damage them.
A printing enterprise shall, within two years from the date of completion of the printing of a publication, keep a sample of a publication that has been commissioned to be printed for reference.
Article 20 Printing enterprises printing notices, circulars, work permits for major events, passes, tickets for circulation and use in society, printing organs, organizations, troops, enterprises and institutions for internal use of valuable or priceless tickets, Printing letters of introduction, work cards, membership cards, access cards, degree certificates, education certificates or other academic certificates, motor vehicle driving licenses, housing ownership certificates and other special certificates with the name of the unit, shall not be retained samples or samples without authorization; If it is necessary to retain samples and proofs for business reference, it shall obtain the consent of the entrusting printing unit, stamp "samples" and "proofs" on the reserved printed copies, and keep them properly and shall not be lost.
Article 21 When implementing the storage system of printed matter, printing operators shall clarify the storage responsibility, improve the storage system, strictly maintain the handover procedures, and ensure that the figures are accurate and well documented.
Chapter V Delivery system of printed matter
Article 22 A printing business operator must print in strict accordance with the printing number specified in the printing power letter or the printing certificate entrusted, and may not make additional prints without authorization.
After completing the printing business of a printed matter, a printing operator shall carefully count the number of printed matter, register the account, and deliver all printed products, originals (or electronic documents), negatives, plates, proofs, etc. to the entrusted printing unit or individual in accordance with the provisions of the contract, and shall not retain them without authorization.
Article 23 Printing operators shall establish printing archives for printed matter, and after completing the printing business of a printed matter, shall file together the printing contract, various certification documents for printing verification and corresponding photocopies, invoices, printing slips, sample books, samples and other relevant materials.
Chapter VI printing activities of defective goods destruction system
Article 24 The printing business operator shall register and record the defective products produced in the printing activities according to the actual quantity, and shall destroy those that cannot be repaired and delivered, and register the name, quantity, time and person responsible for the destruction of the printed copies. Among them, those which are carriers of state secrets or special printed matter shall be destroyed in a timely manner in accordance with the relevant provisions of the State.
Article 25 Operators of the printing industry who use electronic methods to typeset, print or print carriers of state secrets shall handle them in strict accordance with the provisions of relevant laws, regulations or rules.
