At present, the situation of work safety in China is grim and complex, especially in recent years, there have been frequent mine accidents, such as the "November 29" flood in Yuan Jiangshan Coal Mine Leiyang, Hunan Province, and the "December 4" fire in Longshuitong Coal Mine Yongchuan, Chongqing. The "1·10" major explosive explosion accident of Qixiwushan Gold mine and the "2·17" major fire accident of Zhaoyuan Caojiawa Gold Mine occurred in Yantai, Shandong Province within more than a month, which caused serious losses to people's lives and property, and also caused serious social adverse effects. The accident exposed that some enterprises' "people first, life first" concept is not strong, the responsibility for safety production is suspended, the management of outsourcing projects is chaotic, the package management only does not care about the package, illegal fire, illegal storage and use of civil explosives and other problems are prominent. Some local governments and regulatory departments are not strict in their work style, have not learned deep lessons, have taken superficial rectification measures, have not grasped the root causes and essential problems, and have not really been implemented to the grassroots and enterprises, resulting in repeated mistakes.

 In accordance with the provisions of the Production Safety Law, the Mine Safety Law and other laws and regulations, the urgent notice on strengthening the work of production safety in mines is as follows:

1. Illegal blasting and hot operation are strictly prohibited

Mining enterprises that illegally transport, store, distribute or use civilian explosives shall be sealed up or detained according to law; If it constitutes a major potential accident, it shall be ordered to stop production for rectification according to law.

If the mining enterprise has not formulated and implemented the safety operation rules for blasting operations, if the underground explosive storage does not meet the design specifications, if the artillerist does not hold a certificate to work, or if the coal mine does not strictly implement the provisions of "one artillery-three inspections" and "three-person chain blasting", it shall be ordered to make corrections immediately and be given a heavier punishment according to law.

When mining enterprises use electric and gas welding for cutting and welding, they must formulate special safety measures and strictly follow the approval procedures prescribed in the regulations. Electric welding (gas cutting) workers who do not have the qualifications are strictly prohibited from entering the well for hot work. In the event of hot operation at the wellhead and in the wellbore, all operators must be evacuated from the well; All personnel on the return air side must be evacuated in case of hot operation in the main air inlet lane.

Mining enterprises that illegally conduct hot operations at wellheads or underground shall be ordered to stop their operations, immediately eliminate hidden dangers of accidents, and be given a heavier punishment according to law.

2. Illegal subcontracting of underground engineering is strictly prohibited

Where a mining enterprise attaches to a mine or contracts a project to be subcontracted in violation of the law, or a construction unit attaches its construction qualification in violation of the law, it shall be ordered to stop production for rectification and shall be given a heavier punishment according to law.

Where a mine that has been determined for closure arbitrarily organizes production in the name of withdrawal or contracts the withdrawal project to an unqualified enterprise, it shall be shut down immediately, its illegal income shall be confiscated and it shall be given a heavier punishment according to law.

Mining enterprises or holding enterprises shall strengthen the centralized and unified management of the safety of their mines, and shall not delegate responsibility for safety management to other ways such as increasing the level of the company, and investigate the responsibility of higher-level companies in accordance with laws and regulations when accidents occur or there are major accident risks.

Third, it is strictly prohibited to use the eliminated equipment process

Mining enterprises that illegally use non-flame retardant air ducts, conveyor belts, cables, glass fiber reinforced plastics or illegally use dry brake trackless rubber wheels shall be ordered to stop using them immediately; Those who refuse to make corrections shall be ordered to stop production for rectification according to law.

Mining enterprises that use equipment and facilities that are included in the administration of safety standards but fail to obtain safety marks for mining products according to regulations shall be ordered to stop using them immediately; Those who refuse to make corrections shall be ordered to stop production for rectification according to law.

If a coal mine uses a reactive polymer material that has not obtained the safety mark for mining products, it shall be ordered to stop using it immediately, and if it refuses to make corrections, it shall be ordered to stop production for rectification according to law.

Fourth, it is strictly prohibited to organize production without adequate control of major disasters

If a mining enterprise fails to invest the funds necessary to ensure the conditions of safe production in accordance with the regulations and fails to control hidden dangers due to insufficient investment, it shall be ordered to make corrections within a time limit; If it constitutes a potential accident, it shall be ordered to stop production for rectification according to law; If an accident occurs, the principal person in charge and the investor (including the actual controller) of the individual business shall be given a heavier punishment according to law; If the case constitutes a crime, the relevant personnel shall be investigated for criminal responsibility according to law.

If the mine has a serious water disaster and fails to take effective measures of "three special, two exploration and one withdrawal" (equipped with professional and technical personnel, special water exploration and release team, special water exploration and release equipment, using geophysical exploration and drilling to explore and release water, and immediately stopping production and withdrawal of personnel after finding signs of seepage), the implementation of major disaster control measures such as coal mine gas, coal and gas outburst, rock burst and so on is not in place shall be ordered to correct immediately; If it constitutes a major potential accident, it shall be ordered to stop production for rectification.

Fifth, it is strictly prohibited to organize production with super ability and super strength

Mining enterprises that organize production with super capacity shall be ordered to take immediate measures to limit production, and those that pose potential risks of major accidents shall be ordered to stop production for rectification according to law.

In coal mines where mining is out of order and gas is not pumped or not up to standard, production shall be ordered to stop production for rectification according to law.

Where a production plan or business target is issued by a competent department or company at a higher level, it shall be ordered to make corrections immediately and be dealt with seriously in accordance with relevant provisions.

6. It is strictly prohibited to organize production and construction without approval

If a mining enterprise fails to go through the formalities for obtaining its license in full or arbitrarily organizes production and construction without going through the formalities for extending its license as required, it shall be ordered to stop production and construction according to law. Mines that have stopped production for rectification and resume work without approval for inspection and acceptance shall be investigated and dealt with seriously according to law, and those whose circumstances are serious shall be shut down immediately according to law.

If a coal mine crosses the boundary to destroy the security coal pillar, or the mine conceals the place of operation to evade supervision, it shall be ordered to stop production for rectification according to law, and be given a heavier punishment according to law.

Seven, strict safety monitoring facilities and equipment management

Mining enterprises that fail to install safety monitoring systems and personnel location monitoring systems in accordance with regulations or systems that fail to operate normally, modify, delete or shield system data information to evade supervision, shall be ordered to stop production for rectification according to law; If the case constitutes a crime, the relevant personnel shall be investigated for criminal responsibility according to law.

Those who fail to install an online safety monitoring system in operation of the tailings pond shall be ordered to make rectification within a time limit, and those who fail to make rectification within the time limit shall be closed according to law.

8. Strictly lead the class down the well and safety education and training

Mining enterprises that fail to strictly implement the system of mine leaders leading down Wells shall be ordered to make corrections immediately, and the enterprises and principal responsible persons shall be severely punished according to law; Those who fail to conduct safety education and training for underground operators according to regulations, or those who work for special operators without licenses shall be ordered to make corrections and fined according to law, and in serious cases shall be ordered to stop production for rectification.

If a coal mine fails to recruit full-time mine directors, chief engineers and deputy mine directors in charge of safety, production and mechanical and electrical engineering in accordance with regulations, it shall be ordered to stop production for rectification according to law.

9. Strictly implement supervision and supervision instructions

If a mining enterprise is ordered to stop production for rectification, stop construction, stop using relevant equipment and facilities, or immediately take rectification measures to remove the danger, but refuses to carry out the order, it shall be punished by revoking its license or closing down according to law.

Coal mines that are still in production if they are found to have hidden dangers of major accidents twice or more times within three months shall be shut down according to law.

Local safety committees at all levels should grasp the organization and implementation of the above nine measures of "six strictly prohibited and three strictly" in light of local realities, timely study and solve the problems in the work, and focus on carrying out mine safety investigations, and resolutely curb the momentum of mine accidents. The reform of the mine safety supervision and supervision system is to bring the safety of non-coal mines into the scope of national supervision, and the safety supervision of non-coal mines is still responsible for emergency management departments at all levels. Emergency management departments at all levels, departments responsible for coal mine safety supervision and mine safety supervision agencies should strictly perform their duties, strictly implement the responsibility of mine safety supervision and supervision, and close mines, shut down mines, technical transformation mines, infrastructure mines and production mines, tailings ponds, etc. into the scope of supervision, and go to the grassroots to openly and secretly investigate problems and promote rectification. Implement all safety responsibility measures in detail; We will strictly implement the relevant provisions on the connection between the execution of penalties for violations of work safety, and promptly transfer those suspected of constituting crimes to judicial organs in accordance with the law.

All relevant local departments shall, in accordance with the requirements of "the management of industry must be in charge of safety, the management of business must be in charge of safety, and the management of production and operation must be in charge of safety", seize the relevant fields of mine safety work; All localities should actively promote the elimination and withdrawal of mines that do not meet the national industrial policies and safety standards, and severely crack down on illegal mines. If the responsibility for safety supervision is not implemented, illegal mines have not taken effective measures to stop the accident, and illegal power supply and illegal supply of civil explosive materials, the relevant clues will be handed over to the discipline inspection and supervision organ for handling.
